The author presents a legal study on bringing parents to material liability for harm caused by their children. The relevant legislative provisions are analyzed. It is concluded that the civil liability of parents for their illegal behavior (improper upbringing and (or) supervision of minors) is of the individual nature. As the elements of a civil offense are not clearly consolidated, each element that is necessary to bring to civil liability is revealed and described based on research and casual judicial interpretation. The focus is on the delineation of material liability of parents and organizations empowered to supervise juvenile delinquents. Ambiguities in the key aspects of parental responsibility and, as a consequence, heterogeneous case law demonstrate a lack of quality of the law statement.
Delictual capacity of minors, parental responsibility, legal capacity, accommodation apart from the child, presumption of guilt, organization empowered to supervise, responsibility of educational organization, parents' fault, causing harm
