Concerning the legal peculiarities of financial support allocation to Ukraine from the international monetary fund

This article analyzes the legal bases for allocation of the loan to Ukraine by the International Monetary Fund (IMF) under the conditions of the disputed legitimacy of the government that came to power by unconstitutional means. It is concluded, that when the IMF makes a decision, it doesn't follow the principle of government's legitimacy, and the criteria of government's legitimacy as a prerequisite of the financing allocation is not secured de jure. The author also points out, that in the case of Ukraine the IMF implements the practice of recognition de facto of governments by arbitrary definition of the subject, which represents the country in the international financial relations.
