On the issue of the international legal validity of the criminalization of trafficking in human organs and tissues

The article focuses on the problem of trafficking in human organs, tissues and cells, which is relevant for international and domestic law. The main criminological prerequisites for criminalization of illegal trafficking in human organs and (or) tissues are considered. The statistical data of the UN and the WHO on the issue are analyzed. The analysis of existing international treaties in this area (at the global and regional levels) has led to several conclusions. First of all, the need was identified for the adoption at the UN level of a universal mandatory act on the regulation of legal liability for trade in organs and its prevention. In addition, the Criminal Code of the Russian Federation contains a serious gap in the form of the lack of composition of trade in human organs and tissues. All this indicates the incomplete process of forming both international and Russian systems to counter the illegal circulation of organs and tissues.
