On the issue of prospects for improving the legislative regulation of the stage of initiating criminal case in national legal proceedings

The article considers the issue of the advisability of abolishing the stage of initiating a criminal case as a relic of the Soviet period as a prospect for the developing the national legislation. The long-term experience of reforming the criminal-legal system of the Republic of Kazakhstan and the formation of criminal-procedural law in the Russian Federation are analyzed. The opinions of legal scholars and law enforcement officers on the state and prospects for the development of criminal-procedural legislation concerning the pre-trial stage of criminal investigation are given. The analysis allows to conclude that the decision on the need to abandon the stage of initiating a criminal case in the national criminal process is premature, since the possible advantages in this case may result in additional costs and will not solve the tasks.
