On the question of the legal principles of the organization of the peasant (farmer) economy

The article is devoted to the organization of a peasant (farmer) farm, created as an association of persons on the basis of the Law on farms of 2003, and as a corporation on the basis of the norms of Article 86.1 of the Civil Code of the Russian Federation and the general rules on corporations. It highlights the issues of acquiring the status of a peasant (farmer) farm in both forms, the legal status of the head of the farm, his functions, the role in the organization and management of a peasant (farmer) farm, the relationship between the participants. It is concluded that in both forms of peasant (farmer) economy, taking into account the solution of a lot of tasks in the course of its economic activity, there is still a management body, such as a general meeting of participants formed from members of the economy; the concepts of “body” and “position” are not applicable to the head of the economy. It is also proposed to apply a different approach when voting participants on the issue of making a decision in a peasant (farmer) farm.
