The article discusses a number of issues concerning the violation of the Russian Criminal Procedure Code of the Russian Federation when removing criminal case evidence, carrying out the procedure of regarding evidence as inadmissible, applying the American rule of “fruit of the poisonous tree" to the Russian criminal procedure, and the attitude of the European Court for Human Rights to the evidence gained illegally.
