The question of the distinction between trial and pre-trial mediation

The article considers mediation as a way of alternative dispute resolution. The issue of competition of pre-trial dispute resolution methods is analyzed if the parties have provided for the simultaneous use of several of them in the concluded contract. The differences between mediation conducted before and after the parties apply to the court are summarized.
