Purpose: To substantiate the position on the inadmissibility of the formation of the European Court of Human Rights of legal positions, which contain requirements to amend the Constitution of Russia. Methodology: The comparative legal and formal legal methods. Results: On the basis of analysis of rulings by the European Court of Human Rights, which create kvazikoliziyu between the norms of the Russian Constitution and the Convention for the Protection of Human Rights and Fundamental Freedoms, contain a requirement to change the Constitution of the Russian Federation, it is proved that the yield of the relevant international agreements can not be considered as a constructive option resolution of this problem, because its negative effects are minimized, primarily through the application of the legal positions of the Constitutional Court of the Russian Federation on the absolute priority of the Russian Constitution. Novelty/originality/value: The article has a high scientific value because it is one of the first attempts to review the activities of the European Court of Human Rights in a negative aspect of the formation of kvazikollizy between the norms of Russian and international law.
