Towards a system of unjustified enrichment claims

In the article the author analyses the problem of constructing the system of obligations arising from unjustified enrichment on the example of comparative and historical experience. The author believes that in the modern legal discourse two potential variants of the construction of the system may be distinguished: (1) the unitary model (where for any claim the same grounds for its emergence are stipulated) and (2) the particularistic model (where the conditions for the emergence of the obligation depend on the origin of enrichment). The article concludes that the particularistic model is the best option.
