To the issue of combination of theft and possession of narcotic drugs or psychotropic substances

The article deals with issues related to the qualification of thefts of narcotic drugs or psychotropic substances and actions for their subsequent possession in case of cumulative crimes provided for by Art. 229 and Art. 228 of the Criminal Code of the Russian Federation. The attention is drawn to the lack of the unified approach to the legal assessment of such crimes in judicial practice. It is proposed that the issue of cumulative crimes provided for by Art. 229 and Art. 228 of the Criminal Code of the RF should be considered based on the amount of the stolen narcotic drug or psychotropic substance, the stage of theft, the purpose of illegal possession of the stolen narcotic drug or psychotropic substance as well as of the duration of illegal storage of these drug or substance.
