The article examines political and legal subjectivity as a basic unit of social change. Legal subjectivity regulatory framework is analyzed as a subject of civil rights. The importance of the right of ownership is underlined as a fundamental principle of political and legal subjectivity of citizens. The strategic vision of population welfare is also a subject of analysis. The article deals with the «xiaokang» policy focused on the construction of the socialism with Chinese characteristics, which is based on the legal government, social equality and well-developed market economy. The necessity of further Chinese legal system transformation to the capitalist economy is proved since the ownership is of a priority for the formation of political subjectivity.
