To the question of term as essential term of the contract of delivery

The institute of essential conditions is urged to unify system of civil contractual designs, to regulate civil circulation. At the same time reference of any condition to essential often in practice causes difficulties and is result of broad, system, teleologic interpretation of standards of the civil legislation. In particular, the contract of delivery acts as one of contractual designs concerning which there are discussions of theorists and law enforcement officials. In this regard the question of reference of term to essential terms of the contract of delivery is debatable. I believe that distinction in approaches to the solution of the specified question in the civil doctrine, ambiguous positions of judicial instances testify to relevance of this subject.
