On the Issue of the Structure of the Mechanism of Judicial Law-Making (General Theoretical Aspect)

The article analyzes the mechanism of judicial lawmaking. The conducted research required the resolution of a number of tasks, including the establishment of the main approaches to understanding the mechanism of lawmaking that is of a primary nature. The author believes that the specifics of the participation of judicial bodies in lawmaking activities significantly modify the established views on the main elements of the lawmaking mechanism in general and the mechanism of judicial lawmaking in particular.
