On the structure of special part of social security law

Any branch of Russian law is a multi-level structure and includes such elements as regulatory directions and legal institutions. In the structure of the Special part of social security law the author analyzes its development from the Soviet period up to nowadays. The development of social security law in the post Soviet period shows that certain institutions of the Special part of social security law were the subject of research; nevertheless this fact cannot give a complete picture of the structure of the Special part and interaction of its legal institutions with each other and with the system of social security law in general. The analysis of literature also gives no complete picture of the Special part as a structural part of this branch of law. Generalizing the criteria of assigning legal norms into institutions of the Special part we should note that some scholars believe these criteria are the subject of legal regulation and types of guarantees, other think it possible for grouping the norms inside the institutions of the Special part to consider the subjects of social security relations, the third take as the basis of formatting legal institutions organizational legal norms of social security; the fourth separate legal norms and conclude on the necessity of formatting corresponding institutions, the fifth outline the benefit institution in the Special part. On the basis of systematic and functional approaches we study the structure of the Special part of social security law and ground separate institutions inside it: pensions benefits, securing citizens with benefits, duration of employment, securing of those injured at work and suffering occupation deceases, medical aid and treatment, social services, government social aid, relating to determination of legal facts, relating to realization by citizens their rights on this or that type of social security, as well as on solving disputes and complains. Analyzing the above mentioned institutions we make the following conclusions: 1. The Special part of social security law consists of subject and functional institutions; the institutions may be simple as well as complex. 2. Up to nowadays certain institutions are being developed and the development of social security relations may result in the formation of new structural units in this branch of law.
