Civil law contains a mechanism to hold accountable for harm caused to the life and health of a citizen. At the same time, there are contradictions between the legal norms of special legislation regulating these public relations in the provision of medical services, while some issues of liability for harm and its implementation remain unresolved. For this reason, there is no uniform judicial practice when considering cases related to the occurrence of obligations as a result of the special tort under consideration. The article examines the legal prerequisites for bringing to civil law (tort) liability for harm caused to the life and health of a citizen in the provision of medical services.
