On the question of bank guarantee emergence

The article is dedicated to the investigation of creation of guarantor''s obligations. Scientific approaches and ideas about the moment of creation of obligations resulting from the bank guarantee are analysed. A conclusion is made that the only ground for emergence of legal relations on the bank guarantee is the unilateral deal - issue of the bank guarantee. The obligation secured by the bank guarnatee and the agreement on the issue of bank guarantee should not be viewed as a complex set of legal facts but as legal requirements for the issue of bank guarantee.
