The author determines the conditions under which it is possible to preserve the balance of interests of the participants in the process of creating and using the official result of the intellectual activity of the employer and the employee-author of the service result of intellectual activity. Optimal directions of regulation of relations regarding the performance of intellectual activity are proposed.
