The problem of criminal proceedings against the suspect (accused) whose identity is not established permanently attracts the attention of many scientists and it is very important for practitioners. However, the current procedural legislation and normative framework regulating the arrest and detention of the suspect (accused) whose identity is not established, need further researches. The foregoing predetermines the need for legal analysis of certain issues of identification of the suspect (accused) at the present stage of legislation development, it is necessary to determine actual issues arising in this field and offer further ways of improvement. Some aspects to be improved in the Criminal procedure law are revealed. The author initiates legislation aimed at improving the current Criminal Procedure Code of the Russian Federation and this will allow to solve a number of problems encountered by law enforcers while implementing criminal proceedings.
