On the Criminal Liability for Illegal Trafficking of Firearms (a case study of Mongolian and Russian Legislation)

The article attempts to conduct a comparative study of criminal liability for illegal arms trafficking based on the legislation of two border states (Mongolia and the Russian Federation). We have analyzed some articles of the Criminal Code of Mongolia and the Russian Federation concerning illegal arms trafficking, compared and defined in detail the concepts and definitions of firearms based on doctrinal studies by legal scholars of Mongolia and Russia. The comparative analysis of the legislation of border states is based not only on the consideration of criminal law provisions, but also on the features of administrative and civil law regulation. The key emphasis is placed on the legislative and regulatory consolidation of illegal firearms trafficking, its status in present-day conditions, as well as the peculiarities of its regulation in law of the two neighboring countries.
