Teschin A. V. On the issue of the implementation of criminal law mechanisms ensuring the reliability of the evidence in criminal proceedings

The author attempts to study the problems of a theoretical and practical nature related to the change by witnesses during court sessions of their previously given testimony during the preliminary investigation. The interest in this problem is due to the practical lack of scientific papers that would reflect the issues of establishing and implementing criminal liability for crimes that encroach on obtaining evidence. The quality of the investigation and the stability of the court decision and, in general, the effectiveness of criminal procedural activities in a particular criminal case depend on many facts, including the accurate establishment of the reliability of evidence. The article analyzes acquittals and convictions under Part 1 of Article 307 of the Criminal Code of the Russian Federation, and draws conclusions about the reasons for the acquittals. The author pays special attention to the analysis of the shortcomings made by investigators and public prosecutors during the interrogation of participants in the process.
