The concept of conditional sentence in classical and sociological schools of criminal law (historical aspect)

The author of the article reviews the historical aspect of development of conditional sentence, in particular the institute of summary probation. This criminal and legal phenomenon is considered from a position of representatives of sociological and classical school of criminal law. As a result the conclusion is done that at the turn of the 19th and 20th centuries the refusal of absolute implementation of the principle of inevitability of punishment in Russia with gradual transition to the principle of inevitability of criminal liability was enacted gradually and very moderately.
