Constitutional and legal support of fire safety in the organization and implementation of the federal state fire supervision in Russia

In the article the authors consider the sphere of legal support of personal safety from fires on the basisof the analysis of the provisions of the Constitution of the Russian Federation. It is noted that fire safety is one of the components of ensuring the national security of the Russian state and the basic component of ensuring fire safety is the federal state fire supervision carried out in accordance with the federal law. It is concluded that there is a need to reform (repeal) existing regulations on the basis of the principles of continuity and comprehensiveness, taking into account judicial practice and the opinions of experts on the organization and implementation of federal state fire supervision in order to minimize the risk of fires and their consequences, accompanied by death. To reduce the risks of fires and the onset of adverse consequences, accompanied by the death of people, the authors suggest to adjust certain provisions of the Code of Administrative Offenses of the Russian Federation in order to ensure personal safety through the implementation of the principle of inevitability of punishment in relation to subjects who violate fire safety requirements.
