Constitutional legal principles of the right to higher education

This article examines the system of principles of the constitutional rights of a person and a citizen to higher education. It is noted that in accordance with the requirements and prescriptions of the Constitution of the Republic of Kazakhstan, a number of normative legal acts have been developed and adopted, the provisions of which broadly secure the right of a person and citizen to higher education and define mechanisms for the implementation, provision and protection of this right by the state and society. Along with this, the aforementioned list is expanded by a number of international legal documents that have become part of the national legislation of the state. The necessity of expanding the above list of guarantees by introducing organizational conditions into their composition is substantiated, since it is they who provide the organizational component of the activities of the state and its bodies, officials, as well as representatives of civil society in the process of creating conditions for a person to exercise the right to education (higher education). It is proposed to consider the guarantees of the studied law as a system enshrined in the current legislation of the Republic of Kazakhstan, including a complex complex of political, social, economic and cultural means and is the basis for the formation of a state mechanism for ensuring the constitutional right to higher education. Analyzed the doctrinal positions in the scientific classification of guarantees, which ensure the practical implementation of human and civil rights and freedoms.
