Constitutional Foundations of Public Administration and Public Policy in the Higher Education System

The Russian higher education system is going through an era of change. At the same time, its unshakable basis is the provisions of the Constitution of the Russian Federation, which enshrine the right to education, as well as the powers of the Government of the Russian Federation to regulate this sphere of public relations. Thus, approaches to the organization of public administration and public policy in the field of higher education require independent scientific understanding. It is these issues, considered through the prism of constitutional and legal regulation, that are the subject of consideration in this study. The article draws attention to the fact that the principles of state policy in the field of higher education are currently being reviewed and clarified. The author specifies the main reasons for such clarifications, as well as suggests vectors for further improvement of state policy in the field of higher education. For the first time, the authors conduct an analysis of the legislative principles of state regulation of the education system for the period from 2023 to May 2025, which determines the scientific novelty of this article. A number of problems persisting in the higher education system and requiring resolution were also noted. This includes insufficient specification of the principle of information security, the lack of unified educational disciplines on human rights (such disciplines are necessary for the formation of legal culture and legal awareness), and the search for legal forms of digitalization. Finally, the transition to new levels of the higher education system also requires new legislative solutions.
