The constitutional court as a subject of interpretation of the Constitution of the RF

The article the problem of expanding the range of subjects entitled to interpret the norms of the Constitution is touched upon. The author explores the essence of subjective (statistical) and objective (dynamic) concepts of interpretation. The conclusion is substantiated that the provision on the Constitutional Court as the subject-interpreter of the Constitution remains debatable at the present time. Interesting, in our opinion, is the position on the expediency of transferring the right of interpretation to the Parliament (Federal Assembly). The Constitutional Court should be assigned a supervisory function, which would not contradict the presumption: only the body that adopted it can interpret the Constitution. Therefore, the Parliament, on behalf of the multinational people who adopted the Constitution of the Russian Federation, could carry out this type of activity. The author substantiates the proposal on the expediency of transferring the right of interpretation to the Parliament (Federal Assembly of the Russian Federation).
