Information counter-typing in mass media as an object of forensic linguistic expertise

The article is devoted to the analysis of a new phenomenon in modern Russian mass media - information countertyping used for illegal purposes in the creation of conflictogenic texts. The necessary evolution of the methods of legal linguistic expertise in the changing conditions of the mass media space is discussed. The experience and practical recommendations of conducting a forensic linguistic examination of the information counter-typing affecting the honor, dignity and business reputation of an individual are presented. The results of the study allow us to conclude that a purely linguistic category of events and assessments that are still present in the vast majority of expertise and are a tradition held since the 90-ies of the last century should be transformed into a fundamentally important legal categories of fact and opinion, from the differentiation of which the qualification of certain statements as relevant / not relevant fact depends. In this case, the examination is subject to (speech) means, but not (speech) action, which is a speech act, which in modern linguistics is considered as a full-fledged activity with all its components -motive, intention, goal, methods and means of implementation, result. The presumptions of an expert should methodically guide him to find an answer to the question: whether a particular language means can offend, discredit honor, dignity and business reputation, which is more consistent with legal presumptions.
