The author investigates whether the norm of paragraph 3 of Article 845 of the Civil Code of the Russian Federation retains its effect in the context of the application of the provisions of the Federal law «On combating the legalization (laundering) of income...», and what types of control restricting the civil rights of individuals are established by the state. He draws conclusions about the inconsistency of the provisions of the current norms of counteraction legislation with the Constitution of the Russian Federation, the Civil Code of the Russian Federation, about the inadmissibility of such legal regulation of civil legal relations and the need for an immediate reassessment of the adopted regulatory legal acts in order to eliminate the violations of the rights of subjects of civil law and ensure free economic growth and financial stability of the Russian Federation.
