Control and inspection activities of the federal agency for state property management

The analysis of regulatory legal acts, court decisions, scientific sources and educational literature shows the place of one of the entities included in the centralized public administration – the Federal Agency for State Property Management (Rosimushchestvo), in the system of public administration. During the research, formal legal and comparative legal methods were used, which made it possible to comprehensively study the issues of regulating certain areas of the agency’s activity. The analysis of regulatory legal acts according to which control and inspection measures are carried out has been carried out, and the dual nature of regulation of inspection matters has been shown in connection with the duplication of provisions of the Decree of the Government of the Russian Federation № 302 dated March 14, 2024 and the Order of the Ministry of Economic Development of Russia № 598 dated October 26, 2011. The idea of bringing these acts into line, including the elimination of duplication, the cancellation of outdated acts, and the adoption of new ones. It was noted that there are cases where the regulation of the activities of the Federal Property Management Agency is carried out by acts adopted by the Ministry of Economic Development of the Russian Federation, which require revision and the adoption of new Federal Property Management Agency acts that will meet today’s realities and contribute to improving by-laws. Judicial practice has shown the importance of the Federal Property Management Agency’s role in managing federal property, although it is noted that sometimes unreasonable requirements are imposed on audited entities.
