United Nations Convention Against Cybercrime: Challenges in Advocacy Practice and Prospects for Protecting the Rights of Tajikistan Citizens

The objective of this study is to identify systemic issues in the protection of victims’ rights in cybercrime cases in the Republic of Tajikistan based on an analysis of advocacy practice, and to substantiate the necessity of ratifying the United Nations Convention against Cybercrime, adopted by General Assembly resolution 79/243 of 24 December 2024, as a tool for addressing these issues. The research employed methods of analysing law enforcement practice, comparative legal analysis, and formal legal methods. Using a specific example from the author’s practice, the article examines typical challenges faced by lawyers in providing legal assistance to victims of transnational cybercrimes, analyses the evolution of state policy, and identifies gaps in the existing legislation. The author formulates specific proposals for improving legal regulation and enhancing the effectiveness of advocacy activities in this field.
