Emergency: salvation of the life at the expense of life other person

Purpose: Research of questions of application of regulations of the criminal code of Russian Federation of emergency. Methodology: The formal-legal method was used. Results: In article conditions of legitimacy of actions in the conditions of emergency are considered. The author considering a problem of a collision of lives draws a conclusion that causing death to the person for the purpose of elimination of danger of own life will be recognized not criminal an emergency condition only under a condition when the saved life and life of that person from whom it is taken away at the time of damnification were in a condition of danger which implementation inevitably would lead to occurrence of death of both persons. Novelty/originality/value: Article has the high scientific and practical value as is modern attempt of consideration of an actual legal problem.
