Criminalization and criminal justice evaluation of mental disorder infliction from the standpoint of the principle of justice

The aim of the present study is to examine the issues of criminalization and criminal law assessment of mental disorder infliction from the standpoint of the principle of justice, as one of the key and significant foundations of criminal law. The article discusses the positions of various scientists on the topic under the consideration. In addition, a possible differentiation of types of mental disorder as a feature of a number of offences under Chapter 16 of the Criminal Code of the Russian Federation and a number of other norms has been proposed, which also implies a differentiation of criminal liability, taking into account the principle of justice. The authors emphasize the need to combine the efforts of specialists in various branches of knowledge in order to propose reasonable legislative changes regarding the classification of various types of mental disorders. The work proposes organizational and legal ways to resolve a reasonable problem, which is obviously of a medical and legal nature.
