Criminological characteristics of penitentiary crime

The relevance of the stated topic is due to the increasing number of penitentiary crimes and its level of latency in recent years (from 2012-2021). In this connection, the problem of criminological characteristics of penitentiary crime is being actualized in order to develop the most effective measures to prevent it. The analysis of the criminological characteristics of penitentiary crime is carried out. Two blocks of the considered type of crime are distinguished: crimes committed by convicts and crimes committed by correctional officers. The individual crimes included in the structure of penitentiary crime (namely, their state, dynamics, level, specific gravity) are considered, including in a comparative analysis with all registered crimes in the Russian Federation. It is noted that penitentiary crimes are diverse, they encroach on various benefits protected by criminal law by both convicts and correctional institution staff. Penitentiary crime is committed within the boundaries of a penitentiary institution. The results of the study can be applied by the legislator in improving the current legislation of the Russian Federation, which contains measures to prevent penitentiary crime; by law enforcement officers - in the implementation of the prevention of penitentiary crime and in improving the statistical accounting of penitentiary crimes; by scientists - in further studying the criminological characteristics of penitentiary crime and measures to prevent it. As a conclusion, it is noted that the criminological characteristic of penitentiary crime has features that distinguish it from all registered crime and from its other types, which is due to the specifics of the determinative complex that generates the designated type of crime and individual crimes included in it. These criminological features must be taken into account when developing measures to prevent it.
