Criminological determinants (personal level) of illicit drug production, sale or transfer of drugs committed by a person using his or her official position

Introduction: the article discusses the personal reasons for a person to commit illegal production, sale or shipment of drugs using his official position. It is noted that the commission of these crimes is due to the interaction of personal negative properties and qualities of a person with a specific life situation in which an individual is trapped. Materials and Methods: the normative basis of the study is formed by criminal and criminal procedure legislation, the theoretical basis is the works of A.V. Shesler, L.M. Prozumentov, A.B. Sakharov, V.N. Kudryavtsev and other criminologists and researchers of the science of criminal law. The empirical basis of the study was the texts of sentences passed by the courts of the Russian Federation and placed in the state automated system "Justice". The methodological basis of the research was the general dialectical method of scientific cognition, which has a universal character, as well as methods of logical deduction, induction, cognitive methods and techniques of observation, comparison, analysis, generalization and description. The Results of the Study: allowed us to identify the features and compile a criminological characterization of the causes of the personal level of a person committing illegal production, sale or shipment of drugs using his official position. Findings and Conclusions: the basis for the existence of drug-related crime lies not only in the peculiarities and nuances of the national and small social spheres of life, but also in the personality of each individual. In this case, the reasons hidden in the personality are decisive, as it is the personality who realises its negative qualities by committing a crime.
