Criminological determinants of misappropriation or embezzlement committed by a person using his official position

Taking into account the methodological grounds of the doctrine of criminological determinants of crime, the article analyzes the causal complex of misappropriation or embezzlement committed by a person using his official position. The reasons for the considered socially dangerous acts at the social and special criminological levels are highlighted. The significant latent nature of these crimes is indicated, which is caused by low legal activity and distorted legal awareness of citizens. The conclusion is made about the imperfection of sectoral legislation in terms of measures for counteraction to crimes provided for in Part 3 of Art. 160 of the Criminal Code of the Russian Federation.
