Criminological prevention of prohibited means and methods of warfare

The problem of preventing war crimes related to the use of prohibited means and methods of warfare is considered. The practicality of criminological modeling of these crimes is substantiated. The criminological characteristics of the use of prohibited means and methods of warfare are clarified and the author’s interpretation of its elements is given: 1) the criminal legal structure and criminological determinants of the use of prohibited means and methods of warfare; 2) the object of preventive influence is a state that allows the use of prohibited means and methods of warfare, criminal military units; 3) typical types of preventive influence aimed at preventing the use of prohibited means and methods of warfare; 4) the subject of criminological influence is represented by state bodies and public structures. The proposed operations optimize criminological activities to prevent the use of prohibited means and methods of warfare: 1) systematic collection and analysis of data; 2) formalization of criteria for the coverage of criminological effects of manifestations of crime of the type in question; 3) modeling of criminal behavior of persons prone to the use of prohibited means and methods of warfare. The prospects of using modern network means of social communication for the tasks of individualization of preventive effects are noted; 4) assessment of the effectiveness of preventive measures aimed at reducing crime. The sentences handed down by the Supreme Court of the DPR in 90 criminal cases of the specified composition are summarized. Measures of criminological prevention of crimes of this type are proposed: 1) contacting international authorities with information about the commission of war crimes by units of the armed formations of Ukraine; 2) identifying persons among those captured during the SVO involved in the use of prohibited means and methods of warfare and inducing them to cooperate with the investigation.
