Criterion assessment of the reasonable period of criminal proceedings: mechanism and algorithm for its implementation

The purpose of the work is to study the criterion assessment of the reasonable period of criminal proceedings through the mechanism and algorithm for its implementation. The article examines individual problems of theory and law enforcement related to the criterion assessment of a reasonable period. It has been established that the criterion assessment of the reasonable period can be carried out only according to the criteria provided for by the Code of Criminal Procedure of the Russian Federation; the mechanism for implementing the criterion assessment of the reasonable period of criminal proceedings consists of four elements: the object, criteria, circumstances and subjects; the evaluation criteria should include timeliness and expediency. Proposals were formulated to improve certain provisions of Article 6.1. Code of Criminal Procedure of the Russian Federation, algorithm for the implementation of the criterion assessment of the reasonable period of criminal proceedings.
