Legalization of restrictive syncretical norms in legislation of Ancient Rus

The article studies social norms as unanimous, integral norms of behavior, natural to a human being and containing germs of law, moral and religion. It researches the appearance of law as legalization of social and public norms of Ancient Rus in historical sense, as well as the positive effect of studying the conditions and reasons for appearance of restriction of law, determination of its place and role in the life of society and the political system. The article studies and analyzes points of view of A. I. Pershin on “mononorms” and G. V. Maltcev on “syncretical norms”. The conclusion is that the beginning of modern law is connected to the separation of these norms, a part of which found its reflection in written sources of law id est in statute law. The restrictive character lies behind these norms and it is provided by strict compulsion from behalf of the state and determination of the framework of people's freedom of action.
