Mechanism of formation and sustainment of public prosecution: subjects and content of legal relations

The article is devoted to the analysis of the legal status of the subjects of the formation and maintenance of public prosecution in the criminal procedure of the Russian Federation, and also to the associated legal relations. In the article were analyzed problems which are associated with changes in procedural functions of the subjects of the prosecution in pre-trial proceedings. On the example of inquiry in an abbreviated form and the pre-trial cooperation agreement was analyzed an influence of trends of simplifying and optimization of criminal proceedings on the formation of public prosecution. The conclusion about increasing of influence of the administrative factor on those procedures was made. The article is prepared with usage of current scientific researches, the latest changes of the criminal procedure legislation were took into account.
