The mechanism of the psychology of the “first step” when entering into a cooperative relationship with a future agent, subjects, carrying out operational and investigative, intelligence and counterintelligence activities

The present article presents the results of the study of the mechanism of obtaining communicative skills, knowledge and abilities by employees of operational units carrying out operational and investigative activities during recruitment. The study is based on practical experience, service in the operational, and then investigative unit of the Ministry of Internal Affairs of the Russian Federation, as well as other theoretical studies by the author in the process of pedagogical activity, specializing in “Legal support of operational-search activities”. Also, the study of the research of other authors who are specialists in the field of operational-search activities, including the analysis of the research of the school, Doctor of Law, Professor A. Yu. Shumilov. At present, in the regulatory framework, both “open” and “closed” nature, there are no specific methodological recommendations on the algorithm of actions of operational employees in the process of the recruitment procedure of the secret apparatus for operational units. The reason for this problem is that the process of recruitment cannot be fully regulated by positive norms of law, rational norms, since it is an idealistic-irrational concept of the inner world of a person (usually two people). The recruitment process should be carried out on the principle of “feedback”, providing for a response from the person involved in confidential cooperation. The citizen involved in cooperation must understand that the state needs him in the person of highly moral, intellectual and honest law enforcement officers. That is why, when preparing and implementing recruitment, the initiative comes from the subject implementing the operational investigative activity, it is he who gives the first information to the future agent, which will be interesting to him, and not vice versa, as most operational employees and their management are mistaken.
