The place of “selective” cassation in the system of control and verification proceedings of the criminal process

The author analyzes the position of “selective” cassation in the system of other methods and mechanisms of judicial review. The definitions of the concepts of “total” and “selective” cassation are formulated. The objects and jurisdiction of the “selective” cassation are described in detail. The author substantiates the existence of two levels of “selective” cassation, examines each of them from the point of view of their place in the system of judicial review and the tasks facing them. The problem of imbalance in the level of protection of the rights of participants in the criminal process is raised.
