The problem of population ageing has now covered the whole world. There arises a need for legal regulation of this problem. The article examines the legal basis of the status of elderly persons at the international level, analyzes the norms of existing international legal acts in order to determine the degree of settlement of the issue. The matter of the role of the activities of international organizations in protecting the rights of elderly persons is also concerned. Methods of research are dialectical, formal-logical, technical-legal, sociological. As a result, it is concluded that the status of the elderly persons at the international level is not specifically defined. All the norms relating to this category of population are related to soft law. Arguments are given to the necessity of adoption a separate legal act at this level, which would enshrine the rights of the elderly persons and fix guarantees for the realization of these rights.
