The author discusses types of risk the lender at the conclusion of the loan agreement to purchase an individual residential property. Examines how the exclusion of such risks on the basis of clarification given by the higher courts, and also formed a business practice in the field of banking, insurance, debt collection activities. The attention is focused on the need for mechanisms to render the return of funds granted in case of default of debt obligations, including the assignment of claims (cession) to collectors organization. Recommended to make the loan agreement very carefully and with great care, because it makes economic conditions agreed upon by the parties, validity, and its conditions largely depend on opportunities to work with the debtor.
