Multi-episode taking bribes. Distinction from continuing offense

The article is devoted to the problems of differentiation of the continued taking of a bribe and set of the crimes provided by art. 290 of the Criminal code of the Russian Federation are considered. The main problems are identified and ways to solve them are considered. When qualifying the totality of episodes of bribery, it is important not only to be guided by the clarifications of the Resolution of the Plenum of the RF Armed Forces, but also to give a real assessment of the actions of the bribe-taking into account the circumstances of the crime, relying on objective criteria (several episodes of criminal activity, the nature of the actions, are performed under different circumstances, at different times, with an interval, a place, away, etc.), and on the subjective - focus of intent
