The moment of completion of a theft

The article considers the existing approaches in the judicial practice to the decision of the moment of completion of the theft. It’s noted that courts interpreting the moment of completion of the theft take into consideration its form, peculiarities of the subject and those social relations which the theft encroaches on. The necessity of reviewing of court position regarding to the moment of completion of the theft, the responsibility for which is provided for by Articles 226 and 229 of the Criminal Code of the Russian Federation is pointed out. The authors draw attention to the fact that issues related to the completion of the theft of items of particular value (Article 164 of the Criminal Code of the Russian Federation) and theft of nuclear materials or radioactive substances (Article 221 of the Criminal Code of the Russian Federation) require judicial clarification.
