Proper participation in criminal proceedings as a principle of criminal procedure legislation

The article raises the problem of misregulating participation in criminal proceedings of persons with disabilities. Such persons are defined as participants who, because of their physical and/or cognitive difficulties, are limited in exercising their procedural rights and obligations on an equal footing with other participants. Consequently, conditions are formed for violation of their rights as participants in criminal proceedings. As part of the author’s compensatory approach proposed to solve this problem, the issue of supplementing the Criminal Procedure Code of the Russian Federation with a new principle - proper participation in criminal proceedings - is considered. This measure, which corresponds to the ideas of social justice, will contribute to the observance of human rights in criminal proceedings and the development of domestic criminal procedure legislation.
