Intentional default as a basis for recognition of a valid transaction

The grounds provided for in Article 179 of the Civil Code of the Russian Federation for the recognition of the transaction as invalid are investigated - "deliberate silence about the circumstances about which the person was required to report with the good faith required of him under the terms of the turnover."It is established that the current legislation does not disclose the content of the concept of deception, deliberate silence, there is no uniformity in the application of this basis for recognizing the transaction as invalid in judicial practice. The concept is proposed and the content of the basis for recognizing the transaction as invalid is disclosed - "intentional silence". The content of the concept of "intentional content" is disclosed through the categories of "good faith" and "intelligence". The author concluded that "intentional silence" is one of the forms of deception.
