Secret obtaining of biological samples for comparative research in criminal proceedings: an alternative to procedural action or substitution of operational investigative measures

In the article on the basis of the analysis of provisions of the criminal procedure theory and the legislation developing investigative judicial practice the possibility of secret obtaining of biological samples for comparative research in criminal proceedings is considered. For situations associated with refusal (including predicted) of participants of criminal proceedings from voluntary submission of samples of biological origin, the sequence of actions of law enforcers allowing the use of secret obtaining of biological samples for comparative research as an alternative to proceeding method is defined.
