Covert investigative actions: prospects for implementation into the criminal procedural legislation of the Russian Federation

Based on a comparative legal analysis, the phenomenon of «covert investigative actions» provided for by the criminal procedural legislation of a number of former republics of the USSR is examined in the article; their comparison with the investigative actions provided for by the Criminal Procedure Code of the Russian Federation, the production of which includes covert methods of obtaining information is presented; distinctive features of «covert investigative actions» are highlighted. The author substantiates the conclusion that it is promising to expand the range of investigative actions carried out both publicly and secretly in the Russian criminal procedural legislation, so the cognitive activity in which will be of an indirect nature due to obtaining evidence-based information with the help of technical specialists through the use of special technical means, and software and hardware systems.
