Some aspects of legal loopholes influence on effiency of law-enforcement activities

The problems of law enforcement under the circumstances of loopholes in legislation are reviewed in the article. In order to exclude from the scientific lexicon the concept of imaginary loophole, recognition of precedents of sources of law it is proposed that law enforcement activities to be executed by the competent authority by virtue of discretion. Furthermore, the author proposes to introduce the concept «silence of the legislator» into the scientific use.
