Some Aspects of Foreign Criminal Law Experience in Countering Organized Crime and Its Leaders

In this article the author analyzes foreign criminal law experience in combating organized crime and its leaders. The prospects for its implementation in domestic criminal law legislation and application practice are assessed. The author comes to the conclusion that it is advisable to comprehensively combat organized crime, suggesting criminal liability for any assistance to the activities of criminal communities. It seems promising to use Japanese and American experience at the legislative level to define the goals, objectives, structure, characteristics of criminal communities and their leaders, thereby establishing the limits of criminalization. The author also con-cludes that the concept and structure of criminal hierarchy must be clarified. Based on the research, measures are proposed to improve the domestic legal framework, including the development of a new resolution of the Plenum of the Supreme Court of the Russian Federation.
